Quotes & Acceptance
All quotations are valid for 10 days from the date issued unless otherwise stated in writing. After this period, pricing, availability, and proposed start dates may be subject to change.
Acceptance of the quotation, together with payment of the booking deposit, confirms agreement to the quotation, the scope of works, and these Terms & Conditions.
The quotation will set out the project-specific details, including the agreed scope of works, inclusions, exclusions, estimated duration, and payment structure.
Any changes to the quotation, scope of works, or price must be agreed in writing by both parties.
Where the contract is entered into at the client’s home, by email, by phone, or otherwise away from the contractor’s business premises, any statutory cancellation rights that apply will remain unaffected by these Terms & Conditions.
Payment Terms
A 20% booking deposit is required to secure a start date and reserve the project slot in the contractor’s schedule.
The remaining balance will be divided into equal weekly payments based on the estimated project duration, unless otherwise stated in the quotation.
Weekly payments are due every Monday, starting from the first week of work.
The final payment is due upon practical completion of the project and must be paid within 48 hours.
Payments must be made as scheduled while works are ongoing. Failure to maintain the agreed payment schedule may result in suspension of works.
Unless otherwise agreed in writing, all payments must be made by bank transfer.
Late Payments
If any payment is not made on time, the contractor reserves the right to suspend works immediately until payment is received in cleared funds.
Any delay caused by late payment may affect the project timeline and the contractor shall not be responsible for resulting delays to completion.
Where works are suspended due to late payment, the contractor reserves the right to revise the programme, reallocate labour, and charge any reasonable remobilisation or additional costs caused by the delay.
Works will resume only once all overdue sums have been paid.
Booking & Start Date
The booking deposit secures the agreed project slot and reserves time in the contractor’s schedule for the client’s project. No start date is confirmed until the booking deposit has been received.
If the client is not ready to proceed on the agreed start date, the contractor reserves the right to postpone the start date and reallocate the original slot.
If the client cancels the project after accepting the quotation and paying the booking deposit, or is not ready to proceed on the agreed start date, the contractor may retain from the booking deposit such amount as is reasonably necessary to cover losses and costs directly caused by the cancellation or delay, including administration, labour planning, reserved project time, materials ordered, and other project costs already committed.
Where the contractor’s direct loss reasonably exceeds the booking deposit, the contractor reserves the right to recover the additional amount properly incurred.
If the client asks for works to begin during any applicable statutory cancellation period, the client must expressly confirm this in writing and agrees to pay for work carried out and costs reasonably incurred during that period if the contract is later cancelled.
Project Duration
Any estimated project duration is provided as a guideline only and is not a fixed completion deadline unless expressly stated in writing.
Project timelines may be affected by drying times, product curing times, material availability, restricted access, client delays, variations, third-party delays, parking issues, late decisions, and unforeseen conditions discovered during the works.
The contractor will use reasonable efforts to progress the project efficiently, but shall not be liable for delays caused by matters outside the contractor’s reasonable control.
Where delays arise due to the client’s actions, omissions, or late decisions, the project duration may be extended and any resulting additional costs may be charged.
Scope of Work & Variations
The quotation includes only the work specifically listed in the agreed scope of works.
Once the quotation has been accepted and the booking deposit has been paid, the agreed scope of works and quoted price are fixed.
The client may request additional work, upgrades, or changes at any stage. Any such request will be treated as a variation and may incur additional costs and/or affect the project timeline.
The client may not remove, reduce, omit, or substitute items from the agreed scope of works after acceptance in order to reduce the contract price.
Any request to remove or reduce part of the agreed scope after acceptance will only be considered at the contractor’s discretion and must be agreed in writing. Any such agreement will not automatically entitle the client to a reduction in the quoted price, particularly where labour, materials, scheduling, or other costs have already been committed.
No variation will be carried out unless the change and any price or programme implications have been agreed in writing.
Materials
Details of materials supplied by the contractor and/or the client will be outlined in the quotation.
Where the client is supplying materials, fixtures, fittings, or finishes, the client is responsible for ensuring that they are suitable for the intended purpose, available on time, and delivered in good condition.
The contractor is not responsible for delays, defects, incompatibility, shortages, breakages, or performance issues arising from client-supplied materials.
Any additional labour, delay, or remedial work caused by client-supplied materials may incur additional cost.
Any materials, fixtures, fittings, or bespoke items ordered specifically for the project may become non-returnable and chargeable once ordered, even if the client later changes specification or cancels the project.
Access, Working Conditions & Parking
The client agrees to provide reasonable, safe, and uninterrupted access to the property for the duration of the project.
Working hours are typically between 8:00 AM and 6:00 PM, subject to local regulations and the practical needs of the project. Additional hours may be required depending on the stage of the works.
A suitable area must be provided on site for the storage of tools, equipment, and building materials. Storage arrangements will be agreed before commencement where necessary.
The client is responsible for providing suitable parking arrangements for the contractor’s vehicle, including permits, parking suspensions, visitor permits, or parking costs where required.
Restricted access, unsuitable working conditions, lack of storage, or lack of parking may affect the project timeline and may result in additional charges.
Client Responsibilities
The client is responsible for ensuring that the property is ready for works to commence.
The client must provide access to water and electricity for the duration of the project.
The working area must be kept clear, safe, and reasonably free of personal belongings to allow efficient progress of works.
The client must provide decisions, approvals, selections, and information in a timely manner where required for the progress of the works. Delays caused by late decisions or unavailable items may affect the programme and may result in additional cost.
The client must disclose any known issues that may affect the works, including previous leaks, hidden defects, structural concerns, or non-compliant prior work, where known.
Unforeseen Work
The quotation is based on visible conditions at the time of inspection and on the information available to the contractor at that stage.
Any hidden or unforeseen issues discovered during the works, including but not limited to structural defects, rotten timber, water damage, plumbing defects, electrical defects, substrate failure, or previous poor workmanship, may require additional work and may result in additional cost and/or time.
Where reasonably practicable, the contractor will discuss unforeseen work with the client before proceeding.
Where urgent temporary or protective work is reasonably required to make the area safe, prevent damage, or allow the project to continue safely, the contractor may carry out such work and charge accordingly.
Completion & Final Payment
Upon practical completion of the works, the client will be invited to inspect the project on site.
Practical completion means the works are substantially complete and fit for their intended use, excluding minor snagging items or cosmetic adjustments that do not materially affect use.
Any visible issues should be raised at the inspection stage and will be addressed where reasonably possible.
Minor snagging items shall not entitle the client to withhold final payment.
Once the works have reached practical completion, final payment becomes due and must be made within 48 hours.
In the unlikely event that minor snagging items are identified after practical completion, these will be addressed within a reasonable timeframe, subject to access being provided.
No retention sums are held unless expressly agreed in writing before commencement.
Termination
If the client cancels the project after work has commenced, the booking deposit may be applied towards losses and costs already incurred, and the client must pay for all work completed, all materials ordered or allocated to the project, and all costs reasonably incurred up to the date of cancellation.
The contractor reserves the right to suspend or terminate works in cases of non-payment, unsafe working conditions, lack of cooperation, obstructive or unreasonable behaviour, restricted or withdrawn access, failure to provide agreed utilities, or failure to provide approvals or decisions necessary for the works to proceed.
If works are suspended or terminated due to the client’s actions or breach of these Terms & Conditions, the contractor shall be entitled to payment for all work completed, all materials ordered or allocated, all costs incurred, and any additional direct loss reasonably caused by the suspension or termination.
Any suspension of works may result in a revised programme and additional remobilisation or delay costs.
Guarantee
A 12-month workmanship guarantee is provided from the date of practical completion in respect of defects arising directly from the contractor’s installation workmanship.
This guarantee does not cover general wear and tear, misuse, accidental damage, lack of maintenance, deterioration of sealants through normal use, defects in client-supplied materials, manufacturer defects, movement or failure in the existing structure, or issues caused by third parties or external factors outside the contractor’s control.
The guarantee does not apply to work altered, repaired, or interfered with by others after completion.
This guarantee is in addition to, and does not affect, the client’s statutory rights.
Liability
Nothing in these Terms & Conditions shall exclude or limit any liability which cannot lawfully be excluded or limited.
Subject to the above, the contractor shall not be liable for indirect, incidental, special, or consequential losses, including loss of income, loss of profit, loss of enjoyment, or alternative accommodation costs, unless expressly agreed in writing.
The contractor shall not be responsible for defects, delays, damage, or failure arising from client-supplied materials, pre-existing defects, hidden conditions, third-party works, or matters outside the agreed scope of works.
Where damage necessarily occurs as part of opening up, removal, or access required to carry out the agreed works, this shall not in itself constitute negligence, provided the contractor acts with reasonable care and skill.
Subject to the above, the contractor’s total liability in connection with the agreed works shall not exceed the value of the work carried out under the accepted quotation.
